The brother-in-law has been sentenced to nine years in prison for sexually assaulting a 13-year-old girl. The man was charged with two counts of aggravated assault. He pleaded guilty. He perpetrated the sexual assaults on his victim, a 13-year-old disabled girl, between July and March. He must serve 85% of his term before he will be eligible for parole. After he serves his incarceration term, the man, a Mexican immigrant, will be deported to his native Mexico.
Even though the man apologized to the victim of sexual assault during his sentencing hearing, Superior Court Judge had little sympathy. The judge said that the man "preyed upon" his victim who suffers from disability and concluded that his acts were compulsive, repetitive and that the man is likely to commit the actions again.
Unfortunately, sexual assault is a widespread problem. In many cases, victims of sexual assault are children. Children are vulnerable to sexual abuse from infancy through early adulthood. Disabled children are even more susceptible to sexual abuse and assault. In many cases of child sexual assault, the perpetrator of the sexual assault is someone the child knows and trusts. In 90 percent of child sexual abuse cases, the perpetrators are trusted family members or close friends. Most sexually abused children do not tell anyone they were abused, even when directly asked by parents or other authority figures. It is important to contact an experienced sexual assault attorney if you know anyone who has been a victim of sexual assault or rape.
